APPLICABLE RULES

We respect “Party Autonomy” and apply National (Indian) and International Arbitration and Mediation Rules while providing Techno Legal ADR and ODR Services. The Applicable Rules to an Arbitration Proceeding is governed by the “Arbitration Clause” or as has been “Mutually Agreed” to by the parties to Arbitration and Mediation.

If you prefer India as a place of Arbitration and wish to apply India specific Rules, you must be aware of the provisions of Indian Arbitration and Conciliation Act, 1996, as amended from time to time.

If you prefer to apply the Rules and Procedures of any Foreign Country, we would apply the Rules and Procedures of that Foreign Country.

If you prefer to apply the Rules and Procedure of any Foreign ADR/ODR Institution or Organisation, we would apply the Rules and Procedure of that Institution.

If you wish us to “Select and Apply” the most appropriate Rules, Procedure and Forum for you, we would be glad to do so.

If you wish us to “Draft Arbitration Agreement” that can serve your purpose, we would be glad to do so.

Arbitration, Conciliation, Mediation and ODR are “Flexible Procedures” and we fully utilise this aspects.

We wish to make it clear that it is neither possible nor feasible to apply the Rules and Procedures of Foreign Countries and Foreign ADR/ODR Institutions and Organisations “As It Is”. Some modifications, improvements and concessions would always be there. This is so because we can apply the “Rules and Procedures” but we cannot use the Infrastructure, Systems, Payment Gateways, etc of such Foreign Countries and Foreign ADR/ODR Institutions and Organisations.

We have developed our own Systems and Mechanisms in this regard that are Robust, Cyber Secure, Safe and Reliable.

Further, to ensure “Cost Efficiency” and “Minimise Administrative Costs”, we also use Platforms and Methods that require “Least Cost” on the part of Parties to the ADR/ODR process. Further, we also use the “most commonly used methods for Communications and Proceedings” that can be easily used by the Parties and our Neutrals.

In short, the Motto of Perry4Law, PTLB and PTLITC is “Maximum Benefits at Minimum Costs and with Great Ease”.
